Viva Travel Holdings Pty Ltd trading as Viva Escapes & Tours
By booking a tour with Viva Escapes & Tours (referred to as “Viva”, “we”, “our” or “us”), you agree to the following terms and conditions, which form the basis of your contract with Viva Travel Holdings Pty Ltd.
1. Reservations and Deposit
- A non-refundable deposit of AUD $1,000 per person is required at the time of booking to secure your place on the tour.
- Bookings will not be confirmed until the deposit has been received.
- Final payment and any interim payments will be advised in writing and are due in accordance with supplier payment schedules. Failure to pay according to the schedule may result in cancellation of your booking and loss of deposit and other funds paid.
2. Minimum Numbers & Tour Viability
- All tours require a minimum of 8 passengers to operate.
- If minimum numbers are not met, Viva reserves the right to cancel the tour and will provide a full refund of all monies paid.
- Where possible, Viva will offer alternative departure dates or travel options.
3. Cancellations by You
- All cancellations must be made in writing.
- The AUD $1,000 per person deposit is non-refundable under all circumstances.
- Additional cancellation fees may apply depending on the timing of cancellation and the terms and conditions of third-party suppliers.
- No refunds will be given for unused services, voluntary changes, or cancellations made after the tour has commenced.
4. Cancellations or Changes by Viva
- Viva reserves the right to cancel or vary any tour due to unforeseen circumstances, including but not limited to acts of God, force majeure, health pandemics, supplier issues, or failure to reach minimum numbers.
- In the event of cancellation by Viva prior to departure, you will be offered a full refund or the option to transfer to another Viva tour.
- Viva is not liable for any additional costs incurred by you such as airfares, insurance, or travel arrangements not made through Viva.
5. Travel Insurance
- Comprehensive travel insurance is strongly recommended and is your responsibility to obtain. This should cover cancellation, medical, lost baggage, personal liability, and unforeseen events.
- Viva is not responsible for any costs incurred due to inadequate or lack of insurance coverage.
6. Health, Fitness and Special Requirements
- It is your responsibility to advise Viva of any special requirements, medical conditions, allergies, or mobility restrictions at the time of booking.
- Some tours may involve walking on uneven surfaces, steps, or wine cellar visits which may not be accessible to all.
- Viva reserves the right to decline a booking if your participation may adversely affect your health or the enjoyment of the tour by others.
7. Pricing and Inclusions
- Tour prices are quoted in AUD and are based on current exchange rates and supplier pricing.
- Inclusions are clearly specified in the tour itinerary. Items not specifically mentioned (e.g. some meals, optional excursions, personal expenses, tips) are not included.
- Viva reserves the right to adjust prices in the event of currency fluctuations, tax or fuel surcharges, or supplier price changes beyond our control.
8. Passports, Visas and Vaccinations
- You are solely responsible for ensuring you have valid passports, visas (if required), and any necessary health vaccinations or documentation to enter the countries visited on tour.
9. Liability and Responsibility
- Viva acts with due care in the selection of third-party service providers but is not liable for any loss, damage, delay, or injury caused by or resulting from the actions or omissions of these independent suppliers.
- To the extent permitted by law, Viva disclaims any liability for loss (direct or indirect), injury, damage, or delay arising from events beyond our control.
10. Itinerary Variations and Substitutions
- Viva reserves the right to make reasonable changes to the itinerary when necessary, such as changes in accommodation, transport, or scheduled experiences, due to local conditions or supplier availability.
- Any changes will be communicated as early as possible and will be of equal or higher value.
11. Photographs and Marketing
- By joining a Viva tour, you agree that any photographs or video taken during the tour may be used for marketing or promotional purposes without compensation or further approval.
12. Governing Law
- These booking conditions are governed by the laws of the State of Queensland, Australia, and any legal action arising under the contract shall be litigated only in the appropriate court having jurisdiction in Queensland.
